While border security continues to crumble among the absolute crisis at the border, it seems the Biden Administration has reached a new level of desperation. Though detaining children at beyond max capacity for longer than the legal limit in facilities and repeatedly dodging reporters inquiries into the scale of the crisis, may seem bad enough, the sheer pressure of containing the surge of migrants has forced the Biden Administration into a new low. As reported by Fox News, Border Patrol has begun straight-up allowing illegal border crossers into the country without scheduling a court date at the Rio Grande Valley Sector of the border.
“Border Patrol agents in the Rio Grande Valley Sector (RGV) have begun to process and release illegal border crossers who claim asylum without issuing a Notice to Appear (NTA) – allowing them to depart custody without scheduling a court date for a hearing,” Fox News reported on Sunday. “The unprecedented move places the responsibility of seeking an asylum hearing on the migrants through Immigrations and Customs Enforcement (ICE) or legal assistance.”
Generally, when a migrant arrives at the border seeking asylum, they must go through border security to be issued a Notice to Appear before entering the country to ensure they undertake the legal process of immigration in court. However, Border Patrol agents told Fox News they have been instructed to use “prosecutorial discretion (PD) to forgo the hours-long process of paperwork required to issue [a Notice to Appear] amid the surge of migrants at the border.” Migrants are then recorded using biometric data and then, reportedly, allowed into the country.
In terms of open borders, this is just about as close as a border can get without a country simply not having borders. Though the Democratic Party often sheds responsibility, with House Speaker Nancy Pelosi alleging Biden inherited a “broken system” from former President Donald Trump, Biden’s sweeping promises of citizenship and relaxed border enforcement has invited floods of migrants who believe citizenship awaits them if they can simply get in.
“When you create a system that incentivizes people to come across, and they are released, that immediately sends a message to Central America that if you come across you can stay,” Democrat Rep. Vicente Gonzalez (TX), whose district is on the border, told The Washington Post. “It incentivizes droves of people to come, and the only way to slow it down is by changing policy at our doorstep. If they don’t change the policy, the flow of continued migration traffic isn’t going to stop or slow down.”
This report comes amidst a crackdown on the media by the Biden Administration to prevent outlets from reporting the true picture of the border crisis. Multiple news outlets have requested access to or photos from inside migrant facilities have been outright denied.
According to four current and two former Customs and Border Protection officials speaking with NBC News, the media restrictions are being labeled a “gag order” by Border Patrol. Border Agents have been directed to refuse requests for “ride-alongs” along the border from reporters. Local press officers must send all information queries to the press office in Washington for approval. Whatever is occuring at the border, the Biden Administration doesn’t want Americans to know.
